LocalSide Terms of Service
Effective date: [Date of publication]
Last updated: [Date]
These Terms are an agreement between you and [Company legal name], [registered address] ("LocalSide", "we", "us"). They cover your use of the LocalSide mobile app and the website at https://www.localsidetravel.com (together, "the Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. Who can use LocalSide
You must be at least 18 and able to form a binding contract. If you're using LocalSide on behalf of an organisation, you confirm you're authorised to accept these Terms for it.
2. Your account
- Give us an email address you control, and keep your password to yourself. You're responsible for what happens under your account.
- Tell us straight away at support@localsidetravel.com if you think someone else has accessed your account.
- You can delete your account at any time in the app (Profile, then Delete Account). The Privacy Policy explains what that removes.
3. AI-generated itineraries: please read
LocalSide uses artificial intelligence (Anthropic Claude models, through Amazon Bedrock) to suggest itineraries. AI suggestions can be wrong, incomplete or out of date. In particular:
- Opening hours, prices and availability can be wrong or may have changed. Cost figures are rough per-person estimates in US dollars, not quotes, and may not include taxes, tips, transport or booking fees.
- Places may not exist, may have closed, or may be somewhere other than where they're shown. Map pins are found automatically from addresses and can be missing or misplaced.
- Travel times, distances and routes are not checked for feasibility, traffic, road conditions or accessibility.
- Safety isn't assessed. Suggestions aren't checked for personal safety, weather, local laws, health advice, entry requirements, accessibility needs, dietary needs or allergies.
Before you rely on a suggestion, check the important details with the venue, operator or official sources, especially hours, prices, bookings, safety and travel advisories. Use your own judgement: you're responsible for your travel decisions. LocalSide doesn't book anything, isn't a travel agent, and isn't affiliated with or endorsed by any place it suggests.
4. Your content
"Your content" means what you add to LocalSide: trips, itinerary edits, diary notes, photos, your name, bio and profile details.
- You own your content. You give LocalSide a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display your content, only to operate and improve the Service for you. That includes showing it to friends you choose to share with, and sending trip details to our AI provider to generate itineraries. The licence ends when you delete the content or your account, apart from backup copies that expire as described in the Privacy Policy.
- You're responsible for your content. Only upload content you have the right to share. If a photo shows other people, make sure they're comfortable with you sharing it with friends.
- When you share a trip, the friends you share it with can see its itinerary, diary notes and photos. You can stop sharing at any time.
5. Acceptable use
You agree not to:
- upload anything illegal, infringing, sexually explicit, hateful, harassing, or that violates someone's privacy
- use LocalSide to spam or harass people, including sending unwanted friend requests
- try to access other people's accounts or data, or probe, scan or test how vulnerable the Service is
- disrupt or overload the Service, or get around rate limits or other security measures
- scrape, copy or resell the Service or its AI output in bulk, or use it to build a competing product
- reverse-engineer the app, except where the law allows it
- use LocalSide in a way that breaks the law or these Terms
We may remove content or suspend or close accounts that break these rules.
Community conduct, reporting and blocking
LocalSide has no tolerance for objectionable content or abusive users. Be respectful to the people you connect with: don't send friend requests to people who don't want them, and don't share anything with a friend that you wouldn't want reported.
- Report. In the app you can report a trip, a diary entry or a person that breaks these rules. You can also email support@localsidetravel.com. We review every report within 24 hours. If content breaks these Terms, we remove it, and we suspend or close the account of the person who posted it where that's warranted. We don't tell the person you reported who you are.
- Block. You can block anyone you're connected to or who has sent you a request. Blocking ends your friendship or pending request, stops any trip sharing between you in both directions, and stops them sending you friend requests. They aren't notified. You can unblock them later; the friendship doesn't come back on its own.
- Misuse. Don't use reports to harass someone or to get content you simply disagree with removed.
The Privacy Policy explains what a report stores and how long we keep it.
6. Our content and the app
LocalSide, including the app, the site, our design and our brand, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, under these Terms and the rules of the app store you downloaded it from. You can use the itineraries LocalSide generates for you for your own travel.
7. Third-party services
The Service relies on third parties, including Amazon Web Services, Anthropic (through Amazon Bedrock), Apple Maps or Google Maps for maps, and Esri for place data. We're not responsible for third-party services, or for the places, businesses and websites suggested in itineraries.
8. Price
[CONFIRM: pricing model.] The Service is currently provided free of charge. If we introduce paid features, we'll tell you the price and terms before you're charged, and purchases will go through the App Store or Google Play under their terms.
9. Changes to the Service and to these Terms
We may add, change or remove features. If we change these Terms in a significant way, we'll tell you in the app or by email before the changes take effect. If you keep using the Service after that, you accept the new Terms. If you don't agree, you can delete your account.
10. Ending your use
You can stop using LocalSide and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these Terms, if we're legally required to, or if we stop offering the Service. Where it's reasonable, we'll give notice and a chance to export or save your content first. Sections 3, 4 (responsibility for your content), 6, and 11 to 14 survive termination.
11. Disclaimers
To the fullest extent the law allows, the Service, including all AI-generated content, is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the Service will be uninterrupted, error-free or secure, or that itineraries will be accurate, complete, safe or suitable for you.
12. Limitation of liability
To the fullest extent the law allows:
- we're not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, travel costs, missed bookings or goodwill, arising from your use of the Service or your reliance on any suggestion
- our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or [USD 50]
Some jurisdictions don't allow these limits, so they may not apply to you in full. Nothing in these Terms limits liability that can't legally be limited, such as liability for death or personal injury caused by negligence, or for fraud. If you're a consumer, you keep all the rights your local consumer law gives you.
13. Indemnity
If you use the Service in breach of these Terms or the law, or upload content that infringes someone's rights, you agree to cover our reasonable losses and costs from resulting third-party claims, to the extent the law allows.
14. Governing law and disputes
These Terms are governed by the laws of [Jurisdiction], without regard to its conflict-of-laws rules. Disputes will be heard in the courts of [Venue], unless the consumer law where you live gives you the right to bring a claim locally. Before starting a formal dispute, please email support@localsidetravel.com so we can try to sort it out informally. [CONFIRM: whether to add an arbitration clause or class-action waiver for US users. Counsel's call.]
15. App store terms
If you downloaded LocalSide from the Apple App Store:
- These Terms are between you and LocalSide, not Apple. Apple isn't responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you can notify Apple and Apple will refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for the app.
- Apple isn't responsible for any claims relating to the app, including product liability, failure to meet legal or regulatory requirements, or consumer-protection claims. Apple isn't responsible for investigating or defending a claim that the app infringes someone's intellectual property.
- You confirm you're not located in a country subject to a US government embargo or designated as "terrorist-supporting", and that you're not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded LocalSide from Google Play, Google Play's terms also apply to your download.
16. General
These Terms, together with the Privacy Policy, are the whole agreement between you and us about the Service. If a provision is found unenforceable, the rest still applies. If we don't enforce a provision straight away, we haven't waived it. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
